    I’m in ohio and I recently got into pheno hunting and trying to breed my own strain. I am currently working on f2s and I was trying to look into the legallities of selling seeds. I wanted to do it all legal and have a bunch of extra fem seeds from breeding my plants and just didnt want them to go to waste but there is no info on licensing or anything like that anywhere and im not even sure who to contact. I did see something about getting a seed packaging license but that was pertaining to agricultural seeds so I am not sure that applies.

    PS I know that the f2 seeds are not going to be stable and im not looking to start like a big seed business or anything just wanted to sell off some cheap seeds to friends and wanted to go about it legally.

    • Not sure why you would need a cultivation license though since technically the seeds are less than .3% thc and therefore considered hemp. but im as new to this as everyone else and I may be wrong. Just trying to brainstorm ideas on how to figure it out for sure and possibly who to email or contact to ask for a definitive answer.

    • No, but the seeds need to come with a phytosanitary certificate to be legal to ship. Otherwise they can be confiscated. They’re super worried about pathogens being spread around the country via shipping untested, contaminated seeds. It’s treated like more of a civil, Department of Agriculture violation than a criminal offense. But your seeds will still get confiscated, and you can be fined if they bring the attention of authorities.

      Recently there have been a few people getting caught for bringing in unregistered, infected plant material without a phytosanitary certificate and gotten in big trouble. Not related to cannabis seeds, but still kinda interesting stuff.

      • Thanx for the info I think that may be the reason they said you need a seed packaging license. it said that was like 50 dollars a year and you need to take seeds to be inspected and make sure they dont have pathogens

    As I understand it. Seeds are legal to possess and ship. They are below the thc threshold in the 2019 farm bill. Considered the same as hemp seeds. The new 3 per person 6 plant max for us in Ohio will be a hurdle for you. Unfortunately, today the laws are whatever they say they are. Shipping into a state that decides to make an example of you may not end well. I support what you are doing. Let me know if I can assist. Maybe LLC the seed souvenir business and separate it from your residence and grow.😉

    • worth a shot. I know the bill to drop the home grow hasnt gone through the house yet and they are trying to keep it at 12 if you have 2 adults in household. hopefully that stays the way it is. I wasnt sure though if you need a seed packaging licence like you do if you sell seeds for like grain or wheat or something. I know it doesnt technically fall under cannabis law but I was not sure if it falls under ag laws.

      • If starting a seed business or any type of weed business, it is always worth it to talk with a lawyer before. Even if they say its a bad idea, ask them what the reprocussions would be. Could be a bad idea with minimal fines (which to me is whatever) or could be jail time. Get informed by the people that will have to defend you in court.

  • Not sure on the license part of it but I live in ohio as well and if you have too many seeds brother I would gladly take some off you hands and run em so that they dont go to waste 😉

  • I want to organize the Ohio DGC members who would like to meet, share seeds, cuts ect. I’m going to buy some clone shippers we can use.

    • yah I wouldn’t mind getting together at some point. that would be fun. im near the Toledo area but you would have to find a central spot that would work for everyone.

  • Licensing and make sure you have packaging and shipping set up. Shouldn’t be too hard but the license might cost ya

  • I’m going to coordinate Ohio growers to meet, compete and represent in the DGC Cup next year. Maybe we can get together and represent and promote DGC in Ohio events.
